Medical Savings Insurance Company’s Failure to Pay Health Insurance Benefits

Individual certificate/policy holders of Medical Savings Insurance Company (“MSIC”) seek to recover health benefits in the form of charges for health care services and supplies rendered to patients insured by MSIC from 2001 through the present who incurred charges as a result of the insurer’s claims practice of denying payment for covered expenses, allegedly, in violation of the insurance contracts.  There is one main common issue in this case, and it is the same for every patient account or billing included in the Class Damages – i.e., can MSIC ignore the methodology required by its own insurance contract for paying medical providers’ “reasonable and customary charges,” and unilaterally and arbitrarily substitute its own undisclosed Medicare-based methodology.
